The designation serves several purposes: (1) Legal positioning — by selling seeds as collectible adult novelties or souvenirs rather than as agricultural inputs intended for cultivation, sellers position themselves outside agricultural and pharmaceutical regulatory frameworks; (2) Customer protection — buyers acknowledge they are purchasing collectible genetic material, with cultivation responsibility transferring entirely to the buyer based on their local laws; (3) Federal compliance — under federal US law, marijuana cultivation is illegal regardless of state legalization; the novelty-souvenir framework allows seed banks to operate legally while customers handle their own jurisdictional compliance. The model is borrowed from the Dutch cannabis seed industry, which pioneered novelty-souvenir framing in the 1990s as European seed banks expanded internationally — the original Dutch Passion, Sensi Seeds, and Royal Queen Seeds all sold seeds as novelties and souvenirs to customers in jurisdictions where cultivation was illegal. The model has been adopted by virtually all US-based cannabis seed banks including Royal King Seeds, Crop King Seeds (Canada), MSNL, Pacific Seed Bank, and ILGM. What this means for customers: seeds are shipped discreetly to all US states regardless of cultivation legality; customers are responsible for understanding their local laws before germinating; the seeds themselves are legally collectible items (containing only trace cannabinoids in the seed shell); germination converts the legal status of the material under most state and federal frameworks; many seed banks include guidance materials explaining the legal landscape but explicitly disclaim responsibility for cultivation.
