Is marijuana legal in Illinois

As of 2025, marijuana is legal in Illinois for both medical and recreational use, under specific regulations enforced by state law. Illinois was the 11th U.S. state to legalize recreational cannabis, passing the Cannabis Regulation and Tax Act in June 2019, which took effect on January 1, 2020. This law allows adults 21 years and older to purchase and possess cannabis from licensed dispensaries.
Recreational Marijuana
Under the law, Illinois residents can legally possess up to:
- 30 grams of cannabis flower,
- 5 grams of cannabis concentrate, and
- 500 mg of THC in cannabis-infused products (like edibles).
Non-residents can possess up to half of these amounts. Consumption is limited to private residences and select licensed establishments; public consumption remains illegal, including in parks, sidewalks, and vehicles. Landlords and employers can restrict cannabis use on their premises.

Importantly, Illinois also initiated a social equity program, aimed at addressing the impact of past cannabis criminalization. It includes provisions for expunging past low-level cannabis convictions and prioritizing dispensary licenses for individuals from neighborhoods that have been disproportionately impacted by the war on drugs.
Medical Marijuana
Through the Compassionate Use of Medical Cannabis Pilot Program Act, Illinois authorized medical marijuana in 2013. Patients with qualifying conditions—such as cancer, multiple sclerosis, and chronic pain—can obtain a medical marijuana card and access higher possession limits and tax exemptions compared to recreational users.

Medical cannabis patients may also grow up to five plants at home, while recreational users are still prohibited from home cultivation unless they hold a medical license.
Enforcement and Taxation
Cannabis products are taxed based on THC content and product type, with rates ranging from 10% to 25%, in addition to standard sales tax. Violations such as exceeding possession limits or unlicensed sales can still result in legal penalties.
